Xavier University takes all forms of sexual misconduct extremely seriously and encourages reporting.  The university has a sexual misconduct policy in order to prohibit discrimination on the basis of sex or gender and to create a safe learning environment for all members of the Xavier community. Xavier’s policy prohibits behaviors that violate 第九条, including sexual misconduct.

All Xavier employees are considered responsible employees, outside of privileged staff in Violence Prevention Education and Advocacy, Counseling and 健康 Center, Student Health Services and 校园 Ministry. As a responsible employee, you are a mandated reporter of all types of sexual violence, including sexual assault, 家庭暴力, 约会暴力, non-consensual sexual contact, sexual exploitation, sexual harassment and stalking.

As a responsible employee, you are not a confidential resource.  这意味着 if a student tells you they have experienced any form of victimization, you have a duty to report that information to the university’s 第九条 Coordinator, Dr. Jill Moffitt, who can be reached at titleix@flcoastline.com. Bear in mind, you are always an employee of Xavier University. 这意味着, if a student discloses sexual misconduct to you outside of campus, you are still a responsible employee with mandated reporting obligations.

教师 and staff should be advised there are places on campus where students can go for confidential assistance including Violence Prevention Education and Advocacy, Counseling and 健康 Center, Student Health Services and 校园 Ministry. Violence Prevention Education and Advocacy serves as a starting point for students who want to explore their reporting options both on and off campus.  工作人员 provides hospital accompaniment to students needing forensic medical exams, as well as information and accompaniment when filing protective orders in Civil Court. Violence Prevention Education and Advocacy also provides information about abusive relationships, 安全计划, counseling referrals and information about campus and community resources.  Confidential counseling resources are available for faculty and staff who have experienced victimization though 人力资源’ Employee Assistance Program.

The following statement has been drafted for faculty who want to notify students of their mandatory reporting obligations on their syllabus.

不正当的性行为 and Pregnancy Reporting Obligation: If you choose to write, speak or otherwise disclose about having experienced sexual misconduct including sexual assault, non-consensual sexual contact, 家庭暴力, 约会暴力, sexual exploitation, sexual harassment or stalking, federal and state laws require that I, as a responsible employee, notify our campus 第九条 Coordinator. The 第九条 Coordinator will contact you to inform you of your rights and options as a survivor and connect you with support resources, including possibilities for holding the person who harmed you accountable. If you do not want the 第九条 Coordinator notified, instead of disclosing the experience to me, you can speak confidentially with our Director of Violence Prevention Education and Advocacy, 詹妮弗·博德纳尔. 另外, the University has obligations under 第九条 to provide certain support and modifications to people experiencing pregnancy or related conditions in order to ensure their equal access to XULA’s programs and activities. 因此, if you disclose pregnancy or related conditions, I am mandated to report that information to the 第九条 Coordinator. The 第九条 Coordinator will reach out to inform you of your rights, options and possible accommodations.
